These terms govern your use of this website and the landscaping, lawn care and contracting services provided by Fincher's Service LLC ("Fincher's," "we," "us"). By requesting an estimate, booking an appointment, or hiring us, you agree to these terms. If a signed written proposal or contract for your project says something different, that document controls for that project.
On-site estimates are free and carry no obligation. A quote is based on the conditions we can see at the walkthrough and on the scope described in it. Quotes are valid for 30 days unless stated otherwise.
If conditions turn out to be materially different once work begins — buried debris, rock, unstable soil, drainage problems, damaged irrigation, or a change you ask for — we will stop, explain what we found, and give you a revised price in writing before continuing. You are never billed for extra work you have not approved.
Appointment times are estimates, not guarantees — job durations and weather move the schedule. We will let you know if your window changes.
You agree to give our crew safe access to the work area on the scheduled day, including unlocking gates, securing pets, and moving vehicles or personal items out of the way. If we cannot access the site and have to return another day, we may charge a trip fee.
You may cancel or reschedule an estimate or a service visit at any time by calling or texting 260-215-2410. For scheduled project work, please give us as much notice as you can — deposits for ordered materials may be non-refundable once those materials have been purchased.
Payment terms for each project are set out in your proposal or invoice. Larger builds may require a deposit before we order materials or begin work, with the balance due on completion. Recurring maintenance is billed on the cycle stated in your service agreement.
Invoices are due on the date shown. Past-due balances may accrue interest at the maximum rate allowed under Indiana law, and we may suspend further work while an account is past due. You are responsible for reasonable costs of collection, including attorney's fees, on amounts properly owed.
You confirm that you own the property or are authorized to have this work done, and that the work does not violate any HOA rule, easement, permit requirement, or local ordinance. Where a permit is required, we will tell you; unless we agree otherwise in writing, obtaining it is your responsibility.
Before any digging we arrange for public utilities to be located through Indiana 811, as required by law. Public utility lines located through that process are our responsibility to avoid. Private lines are not covered by 811 — invisible dog fences, landscape lighting, irrigation lines, private gas runs to a grill or pool heater, septic components, and similar. Please point these out before we start. We are not liable for damage to private, unmarked or inaccurately marked lines.
Some work leaves marks. Heavy equipment can rut turf, wheelbarrow traffic can compact soil, and excavation near established plantings can disturb roots. We work carefully and clean up after ourselves, but ordinary and unavoidable disturbance of this kind is part of the job, not damage.
Rain, frozen or saturated ground, high heat, storms and other conditions outside our control can delay work or make it unsafe. We may reschedule for weather without penalty. Neither party is liable for delays caused by events beyond reasonable control, including severe weather, material shortages, supplier delays, labor shortages or emergencies.
We stand behind our workmanship. If something we built fails because of how we built it, tell us and we will make it right. Any specific warranty period for your project is stated in your proposal.
Plants, sod and seed are living things and depend on watering, weather, soil, pets and pests once we leave. We cannot guarantee germination, establishment or survival, and seeding results in particular depend heavily on you following the watering instructions we give you. Manufactured materials — pavers, block, lumber, fencing, fabric — carry only the manufacturer's own warranty, which we will pass through to you.
Except as expressly stated here or in your proposal, services are provided without other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
We are fully insured and will provide proof of coverage on request. To the fullest extent permitted by Indiana law, our total liability arising out of any project is limited to the amount you paid us for that project, and we are not liable for indirect, incidental, special or consequential damages, or for lost profits or loss of use. Nothing here limits liability that cannot be limited by law, including for bodily injury caused by our negligence.
We often photograph or film finished work for our website and social media. These images show the landscaping only — never your street address, house number, or family. If you would rather we did not photograph your property, just tell us and we won't.
When you give us your phone number — on a form, on the booking calendar, or in person — you agree that we may call and text you about your estimate, appointment, and project. Message frequency varies with your job. Message and data rates may apply.
Reply STOP to any text to opt out of further messages, or HELP for help. Consent to marketing texts is not a condition of hiring us. We do not sell your mobile number, and we do not share it with third parties for their own marketing.
These terms are governed by the laws of the State of Indiana, and any dispute will be brought in the state or federal courts serving Allen County, Indiana. If any provision is found unenforceable, the rest stays in effect.
We may update these terms from time to time. The "last updated" date above shows when they last changed, and the version in effect when you booked applies to that project.
